About the event
Andrew O’Connell, Administrative Appeals Judge, Environmental and Land Use Hearings Office (ELUHO), will provide a foundational understanding of the design of cap-and-trade and review the history and legal structures of cap-and-trade systems internationally, domestically, and within Washington state. He will cover the legal landscape of Washington’s carbon regulations, including the Climate Commitment Act (Ch. 70A.65 RCW), Cap & Invest program (RCW 70A.65.060), statewide emissions limits (RCW 70A.45.020), and executive-agency jurisdiction for resolving disputes. He will also discuss recent state legislation enabling Washington’s program to link with other cap-and-trade systems, provide a case-law review of recent relevant cases, and summarize current events including the status of I-2117. The CLE is pending for 1.0 credits with the WSBA.
